  • Meretricious relationships

What is a "meretricious relationship", and how can you prove it in order to have control over a dead person's assets?

A term that was created by the Washington State Legislature to define cohabitations that are marital in nature but not on paper. If the court finds that a relationship meets the meretricious definition, then the "relationship property" will be evaluated and divided in an equitable distribution.

Is a meretricious relationship recognized in Washington state after one party dies?

If the court finds that you had a meretricious relationship with the decedent at the time of his death, you will have property interests in the properties that would have been community properties had you two been married with each other.

Whether your relationship would qualify as a meretricious relationship depends on its specific facts. (The term currently preferred by the courts is "a committed intimate relationship".)

Eviction proceedings in WA are very quick. There may be a court hearing in as little as 8 days from the time the summons is served on you and filed with the court.

How long do you have to be in a meretricious relationship before you can receive benefits?

Merely living together, even with sexual contact, likely would not be considered a meretricious relationship, regardless of the length of time. The two persons have to be living like a married couple (commingling resources, sharing goals, etc.).

You can review your specific facts with your attorney to find out your legal options.
