  • rules violated (mediation agreement)

I am aware of a mediation agreement between the Board of my condo association and a resident/owner in the community which has been mediated and the parties signed and committed to an agreement. However, I am now aware that the individual resident/owne has violated the terms to which they agreed, and that the repeated violations have been witnessed by several others in the community, and reported to the Board. However, it appears that the Board has taken no action to enforce the agreement. What can be done to enforce the terms of the mediation, or to motivate the Board to act according to what they, themselves agreed upon?

You can threaten to vote them out; or claim they are in breach of their duties if it also damages you somehow--and sue them.

Our attorneys could also become directly involved, though we normally do charge a fee for that.

    Kind regards.
