    My neighbor constructed a fence that encroaches onto my property. I attached my own fencing to her existing fence that is on my property. This fence dispute has gone on for over two years and has turned into destroying my property, harassment, intimidation, lots of yelling, name calling etc. It has now turned into a physical assault after many months of this.

    I am a 52 yr old woman (widow) and the brother of the owner charged me, I swung out with my hammer and he then shoved me hard to the ground. I am being charged with assault with a weapon.now what??

    In cases of private nuisance, the court can grant an injunction (an order directing the nuisance to cease) and award damages. If the activity is contrary to local bylaws or district or regional plans or other regulations, the local council concerned has responsibility to prosecute, but you may still need your lawyer’s assistance to pursue your legal rights. Neighborhood disputes are ideally suited to mediation. Your lawyer can suggest a suitable mediator.

      You need to be represented by a criminal defence solicitor or barrister, immediately!

      Assault with a hammer could kill someone, so the charges you are facing are serious.
