  • Non Payment of Rent... What kind of letter do I send?

    What kind of letter do I send if a Tenant has vacated without notice and still owes passed due rent? I'm glad she is out and will let go of the lease agreement for the months in contract. Just want to collect the passed due two months of rent. Thank you for any suggestions.

    In what state did this occur?

    And you do realize that just sending a letter is unlikely to get you paid, right? You are almost certainly going to need to sue the former tenant to recover your unpaid rent. While you're at it, you might also consider at least including the unpaid rent that will remain due under their lease until you are able to secure a new tenant.

      I wish to inform you that you may issue a written notice to the tenant demanding rent till the new tenant occupies the premises or you make a reasonable settlement. If the matter is not resolved then you may file a lawsuit. You may demand rent, interest, damages and costs. The burden of proof will be on you in the Court to prove the allegations made by you. The court will consider all the facts and decide the matter.

        It would be helpful if you would supplement your post with the state this occurred in.

        Each state has its own procedures for collecting back rent.

            Post a 3-Day Pay or Quit. Then, on the fourth day, if you have not been paid, take thee to the local magistrate (court house) and file an unlawful detainer.

            When you post the letter, it's best to hand it to the tenant. If you post it on the door jamb, take a photo of it with that day's newspaper with headlines, AND mail the notice by USPS. Tenants lie about receiving things, esp tenants who don't intend to pay.

            Really, though, if you don't know about what kind of "letter" to send, you're in deep waters as a landlord and need to spend some time learning about stuff.
