  • Eviction...even when the lease is up?!

    Hello,

    I am new to the site and just love this whole not having to pay for someone to answer a question that takes a mere moment to answer, plus, you all seam quite educated in your ways.

    I recently moved out of a house that myself and one other individual was renting, both of us are on the lease. Without going too much into detail, can you be evicted from a residence that you no longer occupy and the lease has been up a month prior. Second, can the landlord even file an eviction with knowledge that there is nobody living at this residence / lease is up.

    More information that may help:

    Everything has been paid.
    No Damage to property.
    Keys returned.

    While I know this may be an absurd question, I feel that I need to ask regardless.

    There would be no point unless the other person has done something.
    Due to a recent promotion, I should now be referred to as Major Obvious.

    I would not be trying to provide information and knowledge if I did not sympathize.

    Some days it is just not worth chewing through the restraints to face life.

      The landlord filing an eviction under such circumstances is what is ridiculous. The case needs to be answered, however, for if one does not answer he will be granted an eviction order by default. And that will be court and public record, adversely affecting one's credit for years.

      A long as the individuals on the lease and their belongings are out of the property, rent is paid, then the answer needs to be dismissed as the filing is moot.

        Did you notify the LL you were leaving if it wasn't at the natural end of the lease?

        You mention the lease ended "a month prior". If you were a holdover tenant, staying past the written lease, then you'd be obligated to give proper written notice.

        Be sure to go to court to protect your rights.
