Early Lease Termination in Virginia

I own a townhouse in VA. Its the only rental property I own. The property is currently under lease to a good tennat with a 5/14 expiration date.

My son and family are returning from Paraguay (U.S.A.I.D.)this comming summer and I want to sell them the house which they want to move into in time for the opening of school in Sept of 2013.

The lease states that "This lease is not covered by the Virginia Residential Landlord-Tenant Act." I am pllanning to give 90 days Notice.

Does the lease override my desire to sell the house to my son who has lived in this house years ago as a tenant prior to his assignment overseas.

Both the landlord AND the tenant are LEGALLY bound by the start and end dates of the lease.

The fact that your son live in this house years ago as a tenant and you now wish to sell them this house plays no role in your ability to break your lease with your current tenant (whom, I'm assuming is paying their rent on time and abiding by THEIR requirements in the lease, correct?).

If you wish,you can discuss buying out your tenant (a sort of "cash for keys") deal where, perhaps, you agree to pay your tenants moving expenses and their security deposit on a new rental unit IF they agree to your request to terminate their lease early. However, they are under no obligation to accept this request that they accept this offer from you.
