    We have a rental agreement signed by the Canadian home owners (home is nin Florida) which we rented from Dec 7, 2009 to April 7, 2010. (this is the second year we have rented this same property).
    Due to a medical emergency, we had to come back to Canada and can not go back to Florida this winter.
    We had very good friends who wanted to sub-let the home from us for the months of Feb and March. The home owners said we could not sub-let. We advised the homeowners that we are still responsible for the property until April 7th and that we felt legally we had every right to sub-let.
    We paid half of the rental amount Nov 1 and the remainder Dec 1st so all rent has been paid by us until the end of the contract April 7th. We were going to charge our friends exactly what we paid in rent, just to recoup our loss.
    Do we not have the right to sub-let?
    We now have another couple who are also friends from Ontario who want to rent the property for March.
    Who is right?

    The fact that whether you can sublet the property or not depends upon the lease agreement. If the agreement provides you the right to sub let then you can give on sub lease. Even if you give the property on sub lease the relation between you and the landlord will remain same. Generally a sublet of the property requires permission of the Lessor but however if the Lessor does not give permission as it is likely then the Lessor may even evict the tenant.
