  • Notice to Quit

    I received a 10 day notice to quit from the property manager on October 10, 2006. He stated I had not paid my rent. He was in error, but he has not rescinded the notice to quit in writing which I requested. Can I accept his notice to quit now, November 20, 2006, move out, and not be held liable for the remainder of the rent per my lease agreement which ends the last day of February 2007? He wants me to pay 2 moths rent and forfeit my deposit. I am moving out of state.

    You can argue he breached the lease, and ended it, by improperly trying to force you to leave.

    Save all evidence in case the issue ends up in small claims.
