  • Break of lease because of mice

    We have been having mice in our apartment and the laundry room for 1.5 years. The management has given us traps and has exterminated the building, but it hasn't helped. We have also purchased traps and devices on our own. We have caught 6 already. We keep the apartment very clean by taking the trash daily, washing the dishes and not leaving food outside. After we came back from our vacation this year, we said "no more"! The house was full of mice droppings and the smell was really bad. They were verywhere - on the tables, on the kitchen stove, in our bed!!! We complained to the office again and they said that they already exterminated the building and it would take time until the chemicals start working. Well, one week ago, we didn't put a freshly baked food in the fridge, because it was too hot. We put a cloth on top and we stick it so that the mouse cannot get in there. Well, the mouse made a hole in a cloth and has eaten from our food!!! We started looking for a house and plan to buy one by the end of the year. We want to avoid loosing our deposit and paying for the lease in full (our lease ends in June 07). Please help ASAP.

    It is permitted to break the lease if they have failed to comply with the lease and/or there are health or safety concerns--but save all information, evidence etc. in case they dispute the situation and try to take you to small claims court.
