  • Basement water issues - MN

    I bought a house four years ago in st.paul,mn. At the time of purchase we received a document saying there were no water issues. Since we moved in we have had flooding and leaking issues in the basement. The way the water leaks I find it hard to believe no previous owners had any knowledge of this. I dont know how I would begin to prove this but wondering if this is worth pursuing legal action or is it a dead end? Between previous owner, realtor and inspection agent wondering if I can hold anyone accountable. Im not looking to profit just fix an expensive problem. If I new of water issues I never would have bought the house.

    I wish to inform you water issues in the basement are expensive to repair and it was one of your major concerns in which the previous owner made a misrepresentation to you. Apart from the previous owner, the realtor and the inspection agent are also to blame. You may serve them a written notice. If they do not resolve the matter, you may file a lawsuit. You may claim damages and costs from the other parties. You may present the document stating no water issues in evidence. You may provide expert evidence to establish that water issues have been present from a long time in the building. You will have to prove the claims and allegations made by you. The court will consider all the facts and decide the matter.

      While you say that you don't believe anyone knew about it, it would be up to you to prove that. Unless you can leave someone had knowledge of the issues and intentionally misrepresented the house as having none, you have no legal recourse.

      Before you start an expensive legal pursuit, gather your facts FIRST. Find out what was known and hidden from you, and who knew and failed to disclose it. Start by checking property records to see if there was a previous owner or occupant prior to the seller, or with neighbors when might have been aware of any problems.

        From whom is this "document" that "there were no water issues." The seller? An inspector? That is the first question that needs to be answered before one can try to address your situation now.

        Can you give more information? It is very important who signed that document.
