Hello,

I am entertaining the purchase of property that is currently under-going a Phase 1 environmental assessment. Regardless of the outcome of this assessment, I would like to know what conditions I can put into my offer so that I would not be held responsible should future environmental problems arise. Is there such thing?

You can ask for an environmental indemnification--ie they will pay you if that happens--and you can hold back part of the purchase price in escrow to cover it as well if they would agree...

Plastic, radioactive substances, non degrading substances are the most hazardous environmental problems.
