  • Does Real-Estate Agent has the right to sue us?

    We have signed to buy a new house but we canceled it at the Notary after 6 months because our Real-Estate agent did not sell our own house. We paid a compensation to the vendor as he wanted to sue us. The vendor's agent did not claim any commission but our own agent wanted a commission. Our Notary and lawyer said not to pay her anything. We tried to pay her but she returned the check and wanted more. Now after 2 years, she wants to sue us. Does she has the right to sue us?

    I'm a real estate agent in Canada so your laws may be different than ours. Basically reads the part in your listing contract that states how you will pay her and how the contract will end. In Canda we get paid commission when the sale or purchase of a house closes, meaning the deal is done. In your case it sounds like the deal did not close. You did your due dillegence by paying the people whos house you did not buy but unless your real estate contract stated that you agent can be paid a commision when your house doesn't sell and when the purchase of a new house falls though I don't know how legitamate her claim is. Consult a good lawyer if the commissions she wants are higher than what your legal fees might be.
