I (seller) am in a contractual agreement with someone (buyer) to purchase a vehicle. The tag, tax, and title are all still in my name. We have given possesion of the vehicle to the buyer because at the time we felt confident in his upholding his end of the agreement.
The buyer let another someone (3rd party) borrow the vehicle which is not yet paid-in-full. The 3rd party has dissapeared with the vehicle. Now the buyer is trying to shift all of the blame in to the seller.
The police have been notified. The police have advised me to come and file an unlawful use of vehicle claim.
Is this my best option? What are my legal rights in regards to still receiving payments from the buyer? If the vehicle is recovered can I legally take back possession until payments are complete?
