Urgent help! Could the 17 year old get accused of statutory rape?

If you are a 17 year old that had sex with a person a month before their 17 birthday (16 at the time). Could the 17 year old get accused of statutory rape?

Additional Info: the person who was 17 originally will turn 18 in 6 months. We live in Texas, the law here is that 17 is the legal age of consent.

I wish to inform you that the provisions of Texas Penal Code, Section 22.011(e) will have jurisdiction in this matter. If the accused is not more than 3 years older than the victim and the victim is over 14 years of age then it does not fall under statutory rape.

Keep in mind a clise in age exception may not apply to other charges which are also felonies and require the offender register as sex offender
