  • Not receiving a notice about a fine from Sears

    I haven't receive a notice about the fine from Sears, which this was the place I shoplifted from, and I'm not really sure if they sent it and I don't want to go to court for a notice I haven't received yet. I know that they probably did send one because the person who participated in the crime with me receive theirs already. So what do I do? Who do I call?

    I wish to inform you that if you receive any correspondence from Sears then you can refuse to any criminal charges. If there is theft then generally Sears will inform law enforcement who will investigate the crime and then action may be taken against you. Your action will depend upon evidence available with Sears and action taken by them. If Sears does not take criminal matters then you are not having any matter to contest in court otherwise you may take legal assistance to fight the charges in court. You can also contact legal aid if any police complaint is filed.

      Was this a civil penalty from the store or a citation from the police? If a civil penalty, use the number on your friends letter to call them.
      Due to a recent promotion, I should now be referred to as Major Obvious.

      I would not be trying to provide information and knowledge if I did not sympathize.

      Some days it is just not worth chewing through the restraints to face life.

        If the amount of property stolen or destroyed is not extremely high, there may be no consequences to a Notice of fine. Although it is not advisable to completely ignore a Notice of fine, the company may decide to do nothing if the money owed is not enough to justify time and cost spent in court. If you're unsure whether or not to ignore a Notice of fine, seek legal counsel with someone in your area, as they will be able to give you the best advice pertaining to your particular situation.

          I have a friend who is a retail theft consultant and answers such questions for no fee. He says this letter is called Civil Demand and failure to pay or act on it can carry serious longterm consequences. If your friend just got his letter wait a day or two to see if you get yours or ask any other member of your household if they saw this and thought it junk mail. If not then contact the Law firm that contacted your friend and ask them if they also have your name. You dont want to let this slide as it you do not act in a timely manner your fine can triple! He adds that it was unwise to name store on public forum
