It is submitted that the reason for refusal to entry will be examined in this case. The store or a restaurant can refuse entry into their premises of any person but this should not amount to discrimination. This basically involves that if the practise discriminates a person and smell is because of reasons beyond an individual's control and the same is informed to the store or restaurant then refusal of entry is a discriminatory act and the store or restuarant is liable. If the smell is because of some perfume or other reason which is within control of a person and which has resulted in such smell then it being a non discriminatory act the restaurant or store can refuse entry. Court will see the situation, reason of smell and reson for refusal to entry, etc. and will then decide the matter.
