He has Asperger\'s Syndrome and is protected by a Federal IEP which states that when he misunderstands an assignment he has the right to re-do it with further instruction as to what is expected.     You can try to get a doctor's not to explain the lack of intent. If you can show there was no bad faith involved they will probably try to resolve and perhaps let him do it again for example.

    You can always challenge their decision in court if need be as well.
