    I am looking into setting up a non-profit in order to move lay counseling services that are currently provided under the covering of a religious organization under the covering of this new NFP org. My question is whether there is a difference in the legal insurance covering of such services if the organization is not concidered or listed as a religious organization. Some of the services are provided by licensed MFTs and Psycologists and these people we know can be covered for liability, etc. Our concern is with those those who are deamed lay counselors, who do not have forms of certification that are not legally recognized.
    In short, lay counselors are covered under the insurance held by the church. Will a non-profit not listed as a religious organization be able to obtain the same insurance coverage?

    For a price yes; but the cost is likely to be higher as their potential liability may be higher outside the church. But your insurer would normally be happy to review that situation with you now before you proceed.
