My boss currently owes me 4 months salary. I have only worked for this company for 6 months. I received my first salary check on time, but then was soon told that the company was experiencing financial difficulties and have since received approximately one out of every three salary checks. I have repeatedly been told that accounts payable are expected and I will receive all of my back salary shortly. Unfortunately, I have heard this song and dance a few times and am still waiting. My other opportunities for employment were lost when I took this job and although I am hunting for new employment now, I'm afraid if I leave I will be put last on the list for payment when the money comes in.
I have a couple of employment checks which reflect my salary and I have medical benefits, but I do not have an "employment contract" per se, everything was verbal during the interview and hiring process. The Department of Labor will not help me because they say I make too much money which is ironic, because I am only taking home 1/3 of my "alledged" salary.
Other co-workers are also owed money. I am asked to put in overtime consistantly even though I am not getting paid my full salary. What should I do to ensure my interests are protected? I think I have at least one or two other employees who would join me in legal action if the move would help our cause and not cost us a fortune or put our professional reputations in jeapordy.
