401k monies and a class action

I am part of a class action against LOWE'S HOME IMPROVENMENT for back wages from underpaid overtime, in other words they only paid half time for hours over 40. What my question is can a civil suit be filed for back monies not paid into my 401k through the employer matching contrabution? Thanks, for any input anyone may have. km

You cannot sue for the same issue as is covered by the class action; but if the issue is not covered in the class action, then you can sue. If that is what you mean.
