  • Can I claim for inhouse sales?

    Hello,

    I worked as a mortgage loan officer from Jan 2003 until April 2006 when our office was shutdown. I never received any notice of being terminated. My branch manager just verbally told me the office was shut.

    I was a W2 employee and our office was in Texas.

    In my contract it stated that I must spend at least 51% of my time outside the office. However, I was probably in the office 80% of the time helping the branch manager deal with staff issues, answering phones, doing the admin (office and for closing loans), fixing computers etc

    We didn't have any time clock or timesheet system. it would just be my word against theirs. The only way to proove it is the low number of loans I closed because I wasn't out in the world doing my marketing!!!

    My question is can I claim for inside sales? if so who do I contact and how much should I claim for? is there a set hourly rate? As we were in sales we had no set hours.

      short answer: I want what is owed to me. I'm a fair person I worked hard and they are screwing me (in part to make up for the losses the branch manager made).

      long answer:
      I am still owed commission of several loans. if you are unfamiliar with a commission split let me know and I will explain how it works.

      The mortgage company has claimed that due to various technicalities I am not entitled to the commission on several loans. These are loans where I found the customer, worked with them (one of these loans took 18 months to close) and closed the loan.

      When a loan was closed the loan package was sent to a central records facility, but they have not sent me any copies to back up their claim. My signed copies were locked in the office and the owner refused me access because the mortgage company had not paid the rent!

      So when the office was shut I waited for my unpaid commission checks to be sent to me. Nothing happened so i got in touch and ...short version ... I have been paid on about 70% of what is owed to me.

      The other 30% is a case of what they have stored in their central records department they say does not have my name on and thus I am not entitled to payment.

      if I can claim inside sales I can make up the shortfall. Plus I think 10% extra for this runaround.
