  • Is drive time over time?

    when a two man crew meets at a shop site and leaves in a company truck, is the driver allowed to claim drive time to the work site. and sometimes the work site is in another state so instead of going to the site they have to go to the preset hotel in the work site area. is this time claimable as drive time too. now is the drive time able to be claimed as over time if he has worked 40+ hrs at the job site. his boss is saying that he doesnt have to pay overtime for the drive time. its seperate he says. and that he doesnt even have to pay for the drive time either if he didnt want to. and another question is does the other man not driving but left from the shop site too get paid for the drive time too, or just the driver . this is for the state of alabama

    Normally drive time is to be paid if the drive is to a different location than the main office where the company has its offices etc. You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...
