  • Slander by my previous employer

    My previous employer has started spreading rumors that I have filed a lawsuit against them. This has gotten back to my current employer who now fears that me working for him brings a risk of me filing a lawsuit against him. I have not filed a lawsuit and wonder what actions I can take to stop this from continuing any further and damaging my current employment.

    I wish to inform you that as the information made against you is such which has affected your reputation thus you can file action for defamation. You can first send a notice to your past employer to correct details that you have not filed lawsuit and also demand compensation for loss of your reputation. If defendant does not pay compensation then a lawsuit can be filed.

      File a complaint with the court and submit the court's filing fee. You may file in the state of residence of the party that made the statement or in the state where the false statement was made public. The complaint must state you are bringing the case for defamation of character, cite the relevant state statute and must specify the exact words forming the basis of your lawsuit. Serve a copy of the complaint on the other party and provide proof to the court that you duly served the complaint. Consider retaining an attorney. Defamation cases require special types of pleadings to recover special types of damages. A lawyer will evaluate your case and can pressure the other party to settle out of court saving time and money.

        I suggest you remind your employer a simple check of court records will prove the allegations false.
        Due to a recent promotion, I should now be referred to as Major Obvious.

        I would not be trying to provide information and knowledge if I did not sympathize.

        Some days it is just not worth chewing through the restraints to face life.

          My current employers (I work two jobs) listened to me respectfully, but I can only imagine the worry for them until I prove this to be false. And I fear that filing something against them will make matters worse. I contacted the HR department of my previous employer in hopes that the situation will be fixed but I am a single mother and can't afford for this to affect my employment.
