I came on H1 visa with an New Jersey base company.At the time of my interview
in india ,I signed a contract agreement that I have to work for them
for at least 15 months otherwise I have to pay $16,000 for the same.
However after my joining In USA they changed the duration from 15 months to
18 months. Moreover they added a clause "Term Date".According to this
clause I may have to work for them forever and they can terminate my
contract with or without cause. I felt very uncomfortable that they
are more interested in contract duration than the employee well fare.
I requested them for fair employment but they threatened me to terminate my job.
At that time my financial situation was very bad as I already left my
job with my previous employer in india and already spent lot of money
to join the their USA office.Moreover my wife was pregnant. Hence I
was not in a position to look for a fair employer at that time. So I
had to sign all papers .
During the bench period they forced me to share the kitchen and
bathroom with others persons and they charged $300/week for the same.
They also charged $750 for the travel for initial trip to USA.
After that I successfully passed interviews scheduled by their client
and started work for their client. One day I got a message that they
terminated one employee. I scared so much that they can terminate any
employee any time. I decided even not to go to see my preborn baby in
India. Because I knew that I will get lot of hard discussion from them
as I got after my resignation. Moreover my parents told me that they
can take care of my family but their financial situation was very bad
due to treatment of my preborn baby.
Mean while I got a message from my client that my contract would be
finish on 30 June 2006.I was so much frusted that I decided to look
for a fair employer. Finally I got a decent job. I gave two week
notice period to them on 4th July 2006 .
Initially they didn't accept my resignation and threatened me tp pay
$12000. I got lot of calls in my mobile . I was depressed that they
never ever called me to know my work experience at client side and now
they are calling so many time in a single day.
Finally they filled a lawsuit against me states that I have breached the contract
and they are asking for the compensatory damages, punitive damages, injunctive relief, attorney
