    Not sure if this is the correct forum to post or not. I am a manager at an apartment complex. I am the only one that is employed there. I have been there 6 years. I signed a contract my first year. Until that time, I have not received a new contract until now. I have not signed it and do not plan on it unless they agree to some changes.

    At this point I only have a copy of the draft. I believe this new contract is possibly in retaliation of an accident I had mid Nov. I fell on the next to the last step inside the building where my apartment is located and broke my ankle and had to have surgery and now have 7 pins and a plate. I was off for 5 or 6 weeks. We do not have work comp. They were not happy about that. They were wanting me back 2 weeks after surgery.

    One of the agreements written in the contract is that I live at the apt. complex in an apartment provided at no charge. That was not a problem at first. I spent the weekends coming into the city and staying with my dad. I now stay with him almost full time. He has mild dementia and heart problems. He is ok on his own most of the time but it is better if someone is here. This has never been a problem. At our weekly meeting last week I was informed that I was not allowed to come in to be with my dad even on weekends. We are open 33 hours a week.

    I was reading over the draft again this evening and apparently missed this the first time. It states that I must be available at all times and to let my bosses know where I am at all times. I feel this is an infringement on my personal rights. I am paid for the 33 hours I we are open. Many times I put in more hours than that. We have an emergency # for after hours. The way I am understanding what they are telling me is that I must be available 24/7. For the past 2 years until my accident, I most of my non working hours at my bosses house helping with her mother who is 99. We have grown very attached to each other. I was not paid for this. I actually offered to help out in order for a place to stay when in the city as my sister lived with my dad and we are total opposites. We got along better that way until towards the end when she took a job out of state.

    I am going to get a letter from 3 of my dad's drs. saying someone needs to be here at night. I do not need to be here at dads the total time I am at his house but most of the time I am.

    My final question is if they decide to terminate me because I do not stay out there 24/7 can I be denied unemployment for insubordination?

    All of this is taking a toll on me.

    Generally, the manager of a complex is expected to be there to handle any tenant issues that may arise. If you are in another city part of the week, you are not there to fulfill that part of the job. You are free to not sign the contract, be terminated and risk not receiving UI. Will you? Possibly. You will certainly lose the free apartment.

    I would not be trying to provide information and knowledge if I did not sympathize.

    Some days it is just not worth chewing through the restraints to face life.

      You need to find another position. You agreed to the terms initially,your circumstances have changed so it behooves you to either make a clear understanding now with your employer or look for another position and home.

        Our ours of operation are 33 hours per week. That is what I am paid for. I often put in more hours. I figured out that if I were to be on 24/7 it would be less than $1.00 per hour. We have an after hours emergency # for maintenance. When I did stay out there most of the time, I would go to my apt. and watch tv or play on the computer. Some tenants have my personal cell phone # but I don't get called. I feel that if I have to be on call 24/7 they need to furnish me with a company cell phone. If there was a true emergency, maintenance has my phone # and can get hold of me at any hour. I have my cell on. It only takes me about 20 min. to get out there. Maintenance is only down the street.

        The draft of my contract also says that I have to let management (I am assuming they mean the owners) of where I am at all times. I totally disagree with that. I believe that was put in there because they feel I need to be there 24/7. I have talked to managers at other complexes and some say they either do not live on campus or are not allowed to. I am the only employee there. I feel it is totally unfair and unrealistic of them to expect me to be there 24/7. Although that is not worded in my contract, I was informed that I was not even allowed to come in on weekends. I do have a life. What I do not understand is why it was ok for me to come in (my bosses live about 7 miles from where my dad lives) and stay at their house for 2 years and take care of her mother yet suddenly since I am not doing that anymore, I am not allowed to come in and stay with my dad?

        I feel that if they expect me to stay out there 24/7 they need to really increase my salary,
        plus provide me with a company paid cell phone.

        By being required to stay out there 24/7 they are cutting me off from my family and friends. All my friends live over near where my dad lives, where I grew up. Am I not allowed to come in to go to dr. appts? What about leaving the campus to go to the mall or to the store? I am not making this up, but one time my boss asked me what if there was broken glass in the parking lot? That is a maintenance problem.

        I do not have a problem with being there during business hours. However, once I leave, there is no way for tenants to contact me.

            Because they own the place and you only work there. You are replaceable.
