State of employment-MO
Not sure if this is the correct forum to post or not. I am a manager at an apartment complex. I am the only one that is employed there. I have been there 6 years. I signed a contract my first year. Until that time, I have not received a new contract until now. I have not signed it and do not plan on it unless they agree to some changes.
At this point I only have a copy of the draft. I believe this new contract is possibly in retaliation of an accident I had mid Nov. I fell on the next to the last step inside the building where my apartment is located and broke my ankle and had to have surgery and now have 7 pins and a plate. I was off for 5 or 6 weeks. We do not have work comp. They were not happy about that. They were wanting me back 2 weeks after surgery.
One of the agreements written in the contract is that I live at the apt. complex in an apartment provided at no charge. That was not a problem at first. I spent the weekends coming into the city and staying with my dad. I now stay with him almost full time. He has mild dementia and heart problems. He is ok on his own most of the time but it is better if someone is here. This has never been a problem. At our weekly meeting last week I was informed that I was not allowed to come in to be with my dad even on weekends. We are open 33 hours a week.
I was reading over the draft again this evening and apparently missed this the first time. It states that I must be available at all times and to let my bosses know where I am at all times. I feel this is an infringement on my personal rights. I am paid for the 33 hours I we are open. Many times I put in more hours than that. We have an emergency # for after hours. The way I am understanding what they are telling me is that I must be available 24/7. For the past 2 years until my accident, I most of my non working hours at my bosses house helping with her mother who is 99. We have grown very attached to each other. I was not paid for this. I actually offered to help out in order for a place to stay when in the city as my sister lived with my dad and we are total opposites. We got along better that way until towards the end when she took a job out of state.
I am going to get a letter from 3 of my dad's drs. saying someone needs to be here at night. I do not need to be here at dads the total time I am at his house but most of the time I am.
My final question is if they decide to terminate me because I do not stay out there 24/7 can I be denied unemployment for insubordination?
All of this is taking a toll on me.
