I want to make a internet radio called Y-96 Online. There was a FM radio station here in PR called Y-96 FM. Their slogan was "El Sonido Gigante de Puerto Rico" our slogan is "El Sonido Gigante del Internet". Our logo and colors are different from the former FM station. We plan to play same format of 80s and 90s Top 40 music. Can I be liable by using Y-96 Online??? or a similar slogan? Even if the station is no longer existance?

I wish to inform you that you may be liable as name is similar and further format of playing songs is also similar and thus an ordinary person may get confused. However it is necessary for other radio channel to have a trademark in order to make you liable for its violation. Further if other radio channel had not continuously used the mark in commerce for five (5) consecutive years then their trademark is lost.

Copyright law and music licensing regulations can be confusing. Ensure your online radio station content is legal, even when playing directly from your personal collection. If you provide a station that uses any kind of copyright-protected material, you need to pay a licensing fee. If you are showcasing only local or independent music that is written and performed by bands you are familiar with, get written permission from them to stream their tunes. Hire an attorney.- Quote

Why not use another name? To choose a name of a known radio station is very transparent. Trade on their name and reputation.
Pick other call letters. Unless you want letters from lawyers and to see a summons with your name on it.- Quote
