Court for child citizenship?

Hello, thank you for your answer.

My son is born from an alien mother ( me, i m french living in France with my son ) and an usa citizen dad.
The dad recognised our son in French law and he has our both last name .
But he didn't recognised him in USA and now he doesn't want to sign the paper who prove his presence for last ten years in USA so our son can t have is citizenship.
We are in situation of familly abandon.
I wish to know if i can go to NJ court because of this situation ?
Or how can i help my son to have this double nationality as he can have ?

It does not appear, based on your post, dad was a US citizen at the time child was conceived. Therefore he has no special right to get dual citizenship.

I wish to inform you that if you were married the provisions of Section 301(g) of the INA would apply and if not married then the provisions of “New” Section 309(a) would apply. The father must have physically stayed in USA for at least 5 years out of which 2 years would be above the age of 14 years. The father must give in writing that he will financially support the child till 18 years of age. Only then, your son can acquire US citizenship.

He doesn t want to signed any thing any more but got under child support "control" . Can it be a prove that he will support his son until his 18 ?
