  • Green card problem

    I hope you can give me answer to my question.

    I been searching about green card. my green card is good for 10years but my husband and I were in divorce processing. I seen many answers said green card it will effect my status so I'm so worried and don't know what to do. my husband is US citizen we been married more than four years now but as soon i got here in US we fought most of the time so I runaway to him and asked a help to my friend. I filed divorce then he filed divorce too 2days after I filed divorce. is my immigrant status will affect cause of my divorce? do I need to surrender my green card and just go back to my country before immigration deport me?

    If you both never attended your 2 year hearing and were re-approved then, your green card has been revoked and you are subject to deportation with a ban.
    Due to a recent promotion, I should now be referred to as Major Obvious.

    I would not be trying to provide information and knowledge if I did not sympathize.

    Some days it is just not worth chewing through the restraints to face life.

      I arrived here in US November 14th 2014 then received my green card first week of December but month of February I went back to my country for 3 months then back again here in US but we only spent two weeks together then we separated, wanted to go back in my country but i had no money to buy ticket so im staying with a friend while im waiting for my final divorce,

        Then you failed to legitimize your temporary green card granted through marriage and you are out of status, subject to deportation and a return ban.

          Since you were granted your green card you were granted permanent status. Green cards are usually granted after a marriage of two years. You got yours.

          You do not need to surrender your green card. You are a permanent resident and only have to renew it before it expires.

          Yours is not an uncommon situation. Marriages fail at a rate of almost 50% nowadays. I know firsthand of several couples who divorced after in one case, three years, another after four, and in my own family, after three years. The green card holder did not have to surrender their green cards and are still in the U.S. A green card means permanent resident.

            WRONG! A green card grants permanent status. Once it is issued a divorce alone does not invalidate it.

              Care to reconsider the logic of your statement? She never passed the 2 year interview because she immediately move out and they were not living as husband and wife. The two year interview would have required she and hubby appear testifying they live together in a valid marriage or her legal status is revoked.

                but when I flew here Last year November 14th 2014 we spent together almost 3 months before I went back to my country. and we spent so much time every time he go home to my country. we got married 2011 and we met 2010. Yes we didn't go any interview together.

                  Bingo!!! Your green card is worthless and if you are in the US, you are out of status.
