Question to apply for tourist visa after waiting 10 year penalty

Hello, my case is this: I pleaded for asylum 13 years ago, it was denied in the first hearing and I decided to leave the US 10 years ago on jun 2003, but before I left I filed with the immigration judge I had, for voluntary departure. So I did, they cancelled my tourist visa at their offices in Miami because according to them I didnt filed for an extension while I pleaded for asylum. So, 4 years after leaving the US I applied for a tourist visa at the embassy and they denied it, but they didnt say why. I can only guess they punished me for breaking the law. But on June 2013 I'll complete my 10 year period since I left the US.

My questions are: Do I wait until June 2013 or can I apply for the visa again now? Do you have any suggestion on how should I do it, what should I say or what documents or special forms should i bring. I have 2 brothers, US citizens in the US.

I wish to inform you that you can apply at present as there is no re-entry ban. However if you feel that there is a re-entry ban then you can apply in June 2013. In this regard re-entry ban is imposed if you stay without visa or overstay your visa by 1 year or more. Further for obtaining visa you will have to show your ties to your home country in a manner which justify that you will return to your home country after duration of tourist visa. You may show your family and economic ties in home country. If you desire to settle in USA then your brother can petition you for Green Card under Family of a US Citizen.
