    Hello

    I have been looking for answers and way to do it the right way. I was deported in 2005 from the USA after falling out of status of my F1 visa. I also had a misdeminor domestic charges but i did not do any jail time , just a year probation and some community service. Actually my probation officer set me up when she found out i was not going to school that semester. it's been 8 year now. I left behind my beatifull american daughter miss so much. Since i left i went back to school and i am now a chartered accountant CA .( CPA in the us). I would like to know if i can get in the US in 2015 after my ban and how i could settle there. I am not married but my young brother is already american citizen. Help me

    I wish to inform you that you can re-enter USA in 2015. In this type of visa depends upon your purpose of going to USA. You can enter on tourist visa and come back generally within 6 months and meet your family members or your brother can sponsor you for permanent residency or alternatively you can enter on a work visa and later obtain permanent residency. Your entry in USA will thus be governed by your purpose to enter USA.

      As you will come under additional scrutiny, due to your prior background, do not violate the terms of whatever visa you receive. For example, do not obtain a tourist visa, have your brother file for you to stay, overstay and expect to get away with it.

      I would not be trying to provide information and knowledge if I did not sympathize.

      Some days it is just not worth chewing through the restraints to face life.

        I suggest that you plan very carefully. Not only do you have a history of not honoring the visa you applied for, but you have a criminal history for when you were here previously. Both of those things are likely to affect your ability to get approved for any kind of visa in order to return here legally.

        While you have the equivalent of a CPA, that occupation skill is not so uncommon that it would necessarily qualify you for a work visa. You can apply for a nonimmigrant visa, but as you have already stated, it is your ultimate goal to remain and settle here, so doing so would again invalidate the visa. You can guarantee that USCIS will be questioning you very closely to avoid something like that happening again.

        I would discuss your situation with an immigration attorney and see what they suggest. There is a very good possibility that you may not even get approved to re-enter given your history of criminal activity and overstay.

          Thank you all for your quick reply. I do want to settle , i mean all my brother and sister are there as well as my daughter. They told me back in 2005 that i could apply for a waiver before the 10 years ban or write to the attorney general. I decided to get my education and some work experience in the mean time.
          I definitely need to reenter and be able to work, support my daughter, be in her life.

            Actually, there is no law saying you cannot work where you live and have your daughter visit you over the summer.
