    Hello!
    My fiancee and I are trying to get some perspective on what kind of legal process needs to occur after our wedding in August.
    We are getting married in the states. I am living in the EU (Brussels, Belgium) right now with him. I am here for an internship and have an approrpriate internship visa to allow me to work. We will be returning to the states to marry in August, and we have planned on him just using his Tourist Visa to come and get married

    1. Will that be ok? Or should we apply for a fiancee visa now?

    After we marry, I plan on coming back to the EU where he lives and either find a job or go to a school here to complete a Master's degree.

    2. Will I legally be allowed back into the EU less than 90 days after my internship visa expires? Also, will I need to apply for a separate visa in order to allow me to live/study here in Brussels even though I am married to an EU citizen?

    After moving back to Belgium, we plan to file for a green card for my husband so he will be able to legally live and work in the states, even though we don t know when we will move back...but in the coming 3-5 years most likely.

    3. Will we be able to apply for and receive a green card for him even though we are not currently living in the US? Should we apply for the green card while we are in the states just after the wedding? Is there a local government office that we need to visit in person?

    Please let me know if you know any of these answers or if there is another website I can look at.

    I wish to inform you that a your fiance can marry you in USA on a fiance visa. As a US Citizen you have no restriction in case of travel or moving abroad. If he marries you on any other visa in USA then he will have to justify that marriage was a good faith marriage with a US Citizen. You can go to EU on a student visa. For travel upto 90 days no visa is required under VWP and if stay in EU is more then 90 days then a visa will have to be obtained.

      Sorry but this isnt helpful.

      what about applying for his green card? Also, will I be able to obtain a visa if I am only in the states for a few weeks?

      Would it be advisable for him to get the fiancee visa??? I need more specific help! This generic response is not helpful AFFA
