I am a 31 yr old mother of three. About 7 years ago My now ex-husband and I lost our custody of our 2 oldest children. They we're placed with my ex's grandparents. They haved stayed there with them until I have stightened my life out. I want to get custody of them back but have had a lot of stubbling blocks along the way. Now they have came up to me to try to get me to sign over me rights so they can adopt them. I don't know what to do or how to get past this. Can they adopt them if I don't sign any papers?

I wish to inform you that court considers best interest of child as main consideration. As regards adoption laws of your state will govern your situation but generally adoption cannot be done without consent of parents. In this regard if you will not sign then child cannot be given in adoption unless court takes the view that best interest of child require adoption. You can object to adoption on the ground that at present you can take care of kids and it is best interest of child that child lives with parents.

You were not specific about the "stumbling blocks" that exist now, so it is impossible to venture any advice or opinion.
They cannot force you to give up your parental rights. They cannot adopt them unless and until both you and your husband voluntarily surrender your parental rights so they can be adopted. If an action is begun to terminate your rights, you are entitled to be represented by counsel. At public expense if you cannot afford one. A parent's rights to their children is one of the most precious rights we have so if state action is begun to deprive you of that right, you are entitled to legal representation.
I strongly urge you to seek advice from an experienced family law attorney so you know how to proceed to get your children back.

As you both have no custody rights, it is possible the court will grant them permission to adopt.Due to a recent promotion, I should now be referred to as Major Obvious.
I would not be trying to provide information and knowledge if I did not sympathize.
Some days it is just not worth chewing through the restraints to face life.

I have strightened my life out, but the reason that it to so long is because I was in a abusive marriage. I was finially granted a divorce a year and half ago. I was not going to try to bring those childern in that kind of sitation. Since then I have found a man that is willing to support us like a true family.
