  • Temp guardianship in MI

    I have temporary guardianship of my grandchild in Michigan. The childs mother wants to stay with me also. Is that legal? Being that I have guardianship I don't think it would be but the mother insists that she wants to be where the baby is even though she gave guardianship willingly.

    Sure it is legal. She can also revoke temporary guardianship whenever she chooses. I think you are being set up to provide for her.

    I would not be trying to provide information and knowledge if I did not sympathize.

    Some days it is just not worth chewing through the restraints to face life.

      I wish to inform you that there are 3 types of guardianship under Michigan law - general
      guardianship, limited guardianship, and temporary guardianship. The provisions of MCL 700.5213 will have jurisdiction in the matter of temporary guardianship. A temporary guardian is usually appointed by the Probate Court for 6 months. The provisions of MCL 700.5205 have jurisdiction in the matter of limited guardianship. It requires consent of the parent and is ordered by the Court.

        Unless there is a court order barring the mother from having any contact with the baby, of course she can live under the same roof with the child.

        If the guardianship was granted by the court for some reason the mother is unfit, that's a different situation. But where you say she was the one who gave guardianship, cut her some slack -- identify with her desire to be near her child, see it daily. As you would yours.
