    Re: 1st cousin removed

I wish to inform you that under Marriage (Prohibited Degrees) Act restriction is being placed upon certain marriages. In this Section 2(2) provides that no person shall marry another person if they are related lineally, or as brother or sister or half-brother or half-sister, including by adoption. Hence a marriage may be regarded as void marriage if it comes within purview of Section 2(2).

Marrying a first cousin, is legal within Canada comes up fairly often. The practice of consanguineous marriages between first cousins differs in acceptance throughout the world. Persons related by consanguinity, affinity or adoption are not prohibited from marrying each other by reason only of their relationship, but no person shall marry another person if they are related lineally, or as brother or sister or half-brother or half-sister, including by adoption. A marriage between persons who are related in this manner is void. Although civil marriages between first cousins are not illegal in Canada, some religious institutions do not support this practice. It is best to contact your specific religious institution to determine their position on the marriage of cousins.
