  • Grandparents rights? (they live 90 miles away)

    My son is 3 years old, his father & I split up when he was 6 months old. Since then he has seen his son maybe 6 times & hasn't even made an effort to do so within the last year. He has a wife now & another daughter & basically leaves us alone. I did file for child support but haven't seen a cent yet. His mother has seen my child sporadically over te 3 years, coming here once every couple of months or sending packages, (they live 90 miles away). All in all my son doesn't really know them like he does my parents. She has been asking for a while if I would let my son come down & stay a little while with them but honestly I don't feel at ease with him that far away with someone he doesn't really know, but told them they could come visit him whenever she wanted. Last night she called & threatened me continuously with 'Grandparents rights' saying she would hate to hire an attorney, but legally she could keep him over night & was also obligated to see him two weeks out of every month? That seems a bit drastic, I didn't even realize that they were obligated to two WEEKENDS out of the month. I have never tried to keep them away from him, but I know nothing about this & don't know whether I should hire an attorney or if she's just trying to scare me into letting him come down there.

    Any help would be greatly appreciated!

    Let her hire a lawyer. Grandparents' "rights" have to be established by the courts and in most states they are not recognized as rights as such.

    In lieu of a court order, and you may contest on whatever grounds you believe in the best interests of your child, you have no obligation to turn your child over to anyone. Including them.

    Legally, she has no rights whatsoever, much less to take your child without your assent and then keep over night? Ask her to provide you the statute in your state, first, and you will take it under advisement!

      tell her to go ahead and spend the money for a lawyer if she wants to-she doesnt have an ongoing relationship with the child and cant prove it would be harmful for the child not to see her. you stated already he doesnt really know her so thats a strike agaisnt her already. and shes crazy if she thinks she going to get the child 2 weekends every month
