  • harassment? (restraining order for verbal and mental abuse)

A friend of mine has a girlfriend who has had a restraining order placed on him for verbal and mental abuse, no physical abuse at all....he has honored that order, even though her drug addiction has caused him severe financial and mental anguish and provoked the verbal abuse that caused her to have the order placed again him. but she has continued to call him repeatedly, none of her calls have been responded to...he just wants her to leave him alone and desist the calls...can he have her charged with harrassment? does he have any other course of action to stop any further contact with her?

Oh yes, he most certainly CAN, and SHOULD, have her charged with harassment. She is in violation of her own order, as she's taunting him to have contact with her. She's setting him up to be arrested.

It's a testament to the utter and complete carelessness and laziness of whatever judge signed this PFA order, as there has been no compelling evidence he ever laid a hand on her. Nowadays, all a woman has to do is walk into a courtroom and say "I'm afraid he MIGHT hurt me", and out comes the pen for signing the order. Shame on these judges. She's OBVIOUSLY not afraid of him.

Verbal and mental abuse are not reasons one need fear for their life. Nobody has to stick around and put up with that, but they also are not in imminent danger's path, that of least, which warrants ruining a person's reputation and character, thereby giving them a criminal record.

He MUST inform the court (in which the order was granted) that she's violating the order and therefore request that the order be dismissed. Make sure to advise him to subpoena his telephone records (which will contain the proof of her number showing up on his telephone), and save ALL voice mails from her (if she's made any). When this idiot judge sees how "afraid" of him she really is (not), the order, if the judge has any sense whatsoever, should be dismissed, and it would be even better justice if he could have her held in contempt for filing a frivolous charge against him.

Tell him to get on the ball now, before she gets him arrested. Because it's not a matter of IF that is going to happen. It's a matter of WHEN it's going to happen.
