parenting time, at what age can the kids set the schedule

Re: parenting time / can kids set schedule

When court decides about the visitation schedule it keeps best interest of child in view. In this the court gives due consideration to wishes of the child. Further, the child refusal to meet with a particular parent can also be presented before a court and court will then decide having regard to all factors and best interest of child. However, child visitation laws are made by State so they change from State to State but generally if the child wishes to opt out of the visitation schedule then after attaining majority the child can opt out of visitation schedule.

There is never a time when kids can set the schedule. That is why there are adults, and it's the adults who are given the authority to set the rules. The schedule is set by either a court order, or by the parents. Period

Children are considered legal incompetents, until they reach the age of majority (usually 18),
unless the minor is being abused or in harms way.

Therefore, they cannot make legal decisions about themselves, including their visitation schedule. Instead, it's up to the parents to work out a visitation schedule for their child or children, and then abide by that legal agreement.

Although it IS true that it is up to the parents (and not the children) to come up with a visitation schedule, that does not mean that a child's wishes cannot be taken into account by the parents.

And, even though the parties may sign an agreement stating they are okay with a certain visitation schedule, the spouses also have the ability at any time to file a modification of that schedule if the sitatuion warrants it.

A situation that might cause the schedule to change where the child has some "influence" over what kind of timesharing plan is established is if the child gets along better with one parent over the other, and it is in the best interest of the warring pair to spend less time together. This does not in any way mean the child is dictating the schedule, but at least the child will feel that he or she has the freedom to express his or her feelings over which home he or she feels the most comfortable and happy.

It is also important to take into account that a child may want to be at a certain parent's house more often than with the other parent because the child's main group of friends live close to the "chosen" parent, extracurricular activities are in nearer proximity to that parent, etc.

But overall, it is the parents who have the final say in how the time is split between them when it comes to the custody and visitation of their minor children.

          I hope this helps.

Way to wake up a sleeping thread with a long winded answer to a one sentence question. The OP already got answers and has moved on.
