Living Trust - Mother wants to change it, does she need a lawyer?

  • Living Trust - Mother wants to change it, does she need a lawyer?

    My mother had a living trust drawn up and now she wants to change something in it. Does she need to go to a lawyer or can she state her wishes on paper and then have it notorized? She is on a fixed income and would not be able to afford another fee.

    It is usually best to have counsel with such an important document.

    At least have legal counsel advise HOW to do the amendment.
    Witnesses if any required etc.

    It varies from state to state.

        People do not realize they don't need attorneys for wills/living trusts. All she has to do is amend the old one. As long as she keeps it in a safe place where someone knows where to retrieve it upon her death, that's all she needs to do.

        She simply needs to take the amended document to her notary public and have her signature witnessed.
