Marriage outside of WI - (Marrying in Vegas)

I have a question in regards to Marrying in Vegas. My future partner got divorced in Oct 2010 in WI and remarried in Dec 2010 in Vegas. We both currently live and I know that the state of WI has a 6mth waiting period before able to get married again. We are planning on getting married soon and would like to know if his married in Vegas in 2010 is legal as he didnt wait the 6mths per WI law. Please advise. Thank you Amanda

I wish to inform you that there may be difficulty in recognition of marriage in WI because marriage has been performed in violation of WI laws. Generally if a marriage is made outside state in order to circumvent laws of WI then validity of such a marriage can be contested and declared void.

Wisconsin must recognize the validity of a marriage performed in Nevada as long as it met Nevada laws. The principle is called "comity" which every state must give to the official acts and laws of each of the other 50 states.

There is no waiting period in Nevada to obtain a license. The parties must present themselves with proper i.dentification, the fee is $60.00 with $5.00 extra for debit or credit card, if one has been divorced, then the date and place of divorce must be recorded on the application.Social Security number must be presented as well ,

An Affidavit of Marriage may be obtained to take back to the home state, the license is issued the same day one applies and whoever officiates the marriage must file it with the State within 10 days after the ceremony. Once the license is recorded a copy may be obtained from the Recorder's Office , online from their website.

Marriages are public record in Nevada.
