    If there is a serious disagreement in a divorce about the cat and dog and where they go, how do we resolve that? There are such a thing as filing a motion for that the judge or he just thinks that's silly and childish?
    Neither of us has a lawyer and not too many assets.

    Pets are property, according to law, just like your car, house, and everything else you own.

    California is a community property state where everything is divided equally between you and your spouse.

    If you have to argue the pets (or any other asset) in court, the judge will decide based on whatever evidence each of you provide as to why one of you should get and the other not.

    The simple solution is that one of you gets the cat and the other gets the dog.

    But what do I know. My own experience with divorce is that people get hostile and stupid and don't give an inch. Then the lawyers laugh all the way to their banks.
