    My brother was dating this crazy girl who tries to kill herself everytime he tries to leave her. They eventually broke up. She came crying asking him to marry him so that she can get her citizenship. Dont know ask y he agreed but he did. He married her. After they got married they carried on with their lives seperatly. she had her house and her bills and so did he. In the mist of all this he got her pregnant. She wants them to be a family. He told her that he will be there for my daugher but he is done with her. He filed for divorce because she didnt want him to be in his daughters life unless he agrees to get back with her. She replies that she wants alimony, he commited adultery, was violent to her and neglect his family. The marriage was just to help her get her citizenship. Now she is acting like it was really. What can he do when he gets to court. They never lived together. and she supposely lost her job a month after she received his the divorce papers

    So, in other words, your brother committed immigration fraud by entering into a marriage with this woman solely so that she could obtain her citizenship? Lovely.

    If he completed an I-864 (Affidavit of Support) when he sponsored her, he may well be obligated to support her until she:
    • Becomes a U.S.citizen; or
    • Is credited with 40 quarters of work in the United States (usually 10 years); or
    • Leaves the United States permanently; or
    • Dies.

    I don't know how long the two of them have been married, but unless it's been 5 years or more, a court is unlikely to order spousal support - especially if she has the financial means to live separately, and since she has essentially been doing that ever since they got married.

      He can go to jail. She can go to jail. The child can hang with relatives until mom is deported, when custody needs to be decided.
      Due to a recent promotion, I should now be referred to as Major Obvious.

      I would not be trying to provide information and knowledge if I did not sympathize.

      Some days it is just not worth chewing through the restraints to face life.

          The brother made a commitment to love, honor, and cherish, in order to furnish this woman with citizenship. Unless SHE chooses to try for an annulment based on fraud, HE is going to end up on the losing end of a divorce - and he doesn't want to be, and it's not in her own best interests to do so.

          I'm a bit curious to see how this one turns out myself.

              The best part of it is that while he intended it to be entirely temporary for the purpose of defrauding the US government and getting her the citizenship she wants, he decided to use her for sex, and ended up with a child he has to support.

                Luckily, I have always been on the other side, where the woman is swearing up and down I am the daddy until the paternity test proves otherwise.
