    I have a friend that is going through a rough situation, she is currently battling a divorce, her attorney is saying her case is pretty much lost. here is the situation, she and her husband have been married for a number of years (over fifteen years). prior to her current marriage she had her divorce for a previous marriage signed and filled (so she thought). she then found out that it wasn't filled (by no mistake on her part) four years later. her present husband is asking for an annulment, because he says that they were not legally married. they were married in south Carolina, divorce is happening in north Carolina.

    Also, he is in the military, and has been collecting money from the government for his marriage for over fifteen years. would he be responsible in paying that money back, (if the courts decides they in fact were not married?)

    This should be a no brainer, but apparently it's not.

    If they are not legally married, there is no need for a divorce OR an annulment. How can either be achieved if there is no legal marriage in the first place?

    How exactly is he "collecting money from the government" for being married? No, he will not have to pay any of that back, as he believed he was legitimately married all this time and it was not collusion or subterfuge on his part.
