  • Proof of marital infidelity?

In North Carolina: My brother is married, but he has a female friend that he talks with on the phone on a daily basis. He also gave her his ATM card (the card is in "his" name only, and is used under his verbal supervision. When and how much money she could withdraw) His wife found out and is threatening to take all that he has worked his whole life for, and is threatening to sue his female friend because she was taking money out of his account. In a North Carolina court of law, can any of this be used as proof of marital infidelity?

No way---he can do what he wants with his cash.

    And talk all he wants.

She can still divorce him if she wants of course...
