EX Wife retail theft charge as reason to cut child custody time

Do you think I can get the custody time of our kids by my ex wife halted, because she was arrested for retail theft less than 50 dollars and she paid the store a civil penalty.
I have all the records. We have 50/50 right now.
Is that enough to cut her time if I ask the judge?

Bad as it is, judges often still want both parents to see their kids so cutting all custody time seems unlikely unless you can show real damage occurring to the kids.
But it IS a factor. She can't get too many more strikes against her.
