    TX, Dallas

    Is it legal to let a 15 year old boy drink beer in his house? No I assume but that is what bio dad is doing.

    Can I yank custody from him and have my son testify by court order, and finally cut that wreck of a dad out 100%

    Well first things first.

    Tell bio dad to stop, then if need be perhaps call the cops or social services and get it all documented.

    THEN go to court.

    But it depends what is happening. A sip or 2 is NOT going to make the court or anybody cut dad off 100%, specially in Texas. Something worse than a sip or 2 might encourage the court to intervene and monitor the custody situation more. They are not going to cut dad out 100% in most such cases.

      Maybe under child protection laws but not under the Texas drinking laws.

      CHAPTER 106. PROVISIONS RELATING TO AGE

      Sec. 106.04. CONSUMPTION OF ALCOHOL BY A MINOR. (a) A minor commits an offense if he consumes an alcoholic beverage.
      (b) It is an affirmative defense to prosecution under this section that the alcoholic beverage was consumed in the visible presence of the minor's adult parent, guardian, or spouse.

      Sec. 106.06. PURCHASE OF ALCOHOL FOR A MINOR; FURNISHING ALCOHOL TO A MINOR.
      (a) Except as provided in Subsection (b) of this section, a person commits an offense if he purchases an alcoholic beverage for or gives or makes available an alcoholic beverage to a minor with criminal negligence.
      (a) Except as provided in Subsection (b) of this section, a person commits an offense if he purchases an alcoholic beverage for or gives or with criminal negligence makes available an alcoholic beverage to a minor.
      (b) A person may purchase an alcoholic beverage for or give an alcoholic beverage to a minor if the person is:
      (1) the minor's adult parent, guardian, or spouse, or an adult in whose custody the minor has been committed by a court, and is visibly present when the minor possesses or consumes the alcoholic beverage


      The alcohol statutes let Dad off the hook.

      Child Protective Services might be willing to get involved if they can be convinced that the child in endangered.

            Your FIRST action is to request Dad to cease this practice. Do so verbally and via text or email. You will need proof this is happening how often and how much child is drinking.
