i have an important question..i recently became pregnant and my child father wants nothing to do with the baby and we both decided that it would be best if he signs his rights over so my girlfriend and I can raise the child...is this possible if so how do we start this process and when??

A father can voluntarily surrender all parental rights usually only if there is a stepparent adoption in the wind. The law upholds a child's rights to two parents -- the biological parents.

Only in situations where there is a stepparent, a stable marriage relationship, would the court entertain a stepparent adoption. Termination of a father's rights to his child -- and the child's right to the father -- would not be approved to go two two 'girlfriends.'

Generally, absent fraud, a court will not permit a parent to sign away rights. The child has rights.

I wish to inform you that if you are not married to the father of the child then the father of the child will have no rights over the child till parentage is established. If the name of the father does not appear on the birth certificate and the father does not establish paternity then the father will have no rights. However, if the father files a petition and paternity is established then he can further petition the court for child custody and visitation. In that case, he will have to sign away his parental rights thereafter at that stage.
