  • Indiana, child support laws.

    my children are all grown,the youngest is 24.i have back child support coming out of my check each week&they've taken mine&my wifes taxes,put liens on are cars&took the insurance money from one of the cars.i'm wanting to buy a house.i can take a 1st time home owners loan from my 401k,but i hear they will take it,can they?

    I wish to inform you that arrears of child support can be demanded by other parent. Generally child support is paid only till the child becomes 18 and if any amount is not paid then that amount can be claimed from you. If any other amount is being taken then you can file a motion in court that such payment should be stopped as it is adversely affecting your finances and further your youngest child is now 24 and not dependent upon other parent for expenses. Child support is paid to other parent for meeting expenses of child. Lastly your wife assets and income cannot be taken for your child support liability and if any such thing has happened then relief can be sought from court.

      You're kidding me, right?

      You have child support arrears. You don't need to be buying a house, you need to be taking a withdrawal to PAY YOUR CHILD SUPPORT.

      In fact, depending on your state, the child's mother and/or CSE should be going after your 401k to use those funds to pay off your back child support.

        Yes. Any and all delinquencies will be paid up, by whatever means necessary until the balance is paid in full.
