    I have Sole legal and physical custody in MD. My new husband has joined the army and we may have to leave the state. My ex found out and says he will try to stop me from moving. What legal grounds do I have. What should I do?

    Most courts will let you move if the reason is valid and based on economics.

      Okay since you have sole/legal physical Custody of the child and he has joint he has a say in where you move but this is what you can do.. File with the courts a change of Domicile stating that your new husband is being transferred to another state do to his job and that there is better pay involved and that the housing is already established since he is in the army..Most likely what will happen is the judge will ask for proof that there is a home waiting for you there and what the income is that you will get from what you have..Plus if your husband asked to be there of if that is where the army placed him.. They will allow you to move as long as you follow the procedure of the courts asking for permission to allow you to move to another state to have better income and housing for you and your family..there isn't much the father can say except his concern on visitation..It will depend on the age of the child as well if the child is a baby the judge will ask if there is some way that you can stay in the states If there is no possible way then he may grant it but you will have to travel half way so the father can have his visitation or make some agreement that he will not have less parenting time with his child then he has now.. Judges don't like the father loosing visitation time with there child but if there is some kind of agreement that can be made that he can see or take the child for a reasonable amount of time with the child.
