I am the custodial parent of my child. I allowed my child to live in Florida with the man who raised him since he was 3 for the present school year. His biological father, who has not been a part of his life or paid any child support, found out and signed an affidavit to have my son picked up and taken to stay with his mother. Does he have the right to do that? What are my options as far as getting my son back?

Normally no if you have primary legal custody. You make those decisions. Take your court orders to the local police or those involved and you may exercise the rights granted by the court order. -

If you are the custodial parent by court order then he would need to go to court to take the child or set up visitation.Comment
