released from jail by mistake

    had felony charges on top of miscdemenor warrent, had to do 1 year in jail, on the misc., after the felony charges were dealt with. sat in jail 82 days until court to plead to 5 yrs felony probation. but got released from jail when felony court was over, this was done with the courts knowledge , as well as the jailers knowledge, even though still had a year to serve on misc side. after 82 days without seeing his kids, and being a little confused on everything, he left and went home. now the police are searching for him and issued a warrent. my ? is ...if they can issue a new warrent for him leaving when his time wasnt served, wouldnt the court system be at fault also? kinda like accomplise to a crime, i would think.just dont seem right, to me.

    It may not seem "right" to be unable to trade on the court's mistake. But since they discovered it, he has to own up and show up. Or else he will be arrested -- perhaps in front of his kids.

    He has to man up, show up, and serve the rest of his time. If anyone aids him by hiding him, they will be charged as an accomplice for shielding, harboring a convicted felon.

      and also he has went to every felony probation appointment, like he is supose to, and he has even mentioned he was released from jail when he had miscdemeanor time to serve. they havnt arrested him. it just is so confusing to me.

          What is so confusing? He has jail time to serve, he must serve it. That is not rocket science.
          Due to a recent promotion, I should now be referred to as Major Obvious.

          I would not be trying to provide information and knowledge if I did not sympathize.

          Some days it is just not worth chewing through the restraints to face life.

            what is so confusing is that he goes to see his felony probation officewr reg. and he doesnt get arrested.

              Apparently the PO is not aware of the warrant.
              Due to a recent promotion, I should now be referred to as Major Obvious.

              I would not be trying to provide information and knowledge if I did not sympathize.

              Some days it is just not worth chewing through the restraints to face life.
